These Terms (“Terms”) are between LaunchSite Marketing LLC (“LaunchSite,” “we,” “us”) and the Client named on an Order Form, Proposal, or Checkout Page (“Client,” “you”). By approving the Design Preview or otherwise using the Services, you agree to these Terms.

We provide website design, build, hosting, and ongoing care for small businesses. Optional add-ons include Online Ordering and Online Bookings. The Order Form/Proposal states your selected services and prices. These Terms govern all Services unless we both sign a different written agreement.

  • Fair-Use – The monthly time guide for Small Edits (see §6).

  • Add-Ons – Online Ordering and/or Online Bookings managed by us.

  • Buy-Out – One-time fee to transfer the site design deliverables (see §9).

  • What you get. Up to 5 pages for the Core Website plan, and 8 pages for both Online Ordering and Online Booking websites. (e.g., Home, Services, About, Pricing, Contact), mobile-first design, basic on-page SEO (titles, meta, headings, internal links), hosting & SSL, performance best practices, and a 30-day post-launch bug-fix warranty.

  • One-Time Google Business Profile (GBP) Setup. We will create or claim/verify your Google Business Profile, configure NAP (name, address, phone), primary/secondary categories, services, hours (including special hours), business description, logo/cover photo, links to your website/booking/ordering (as applicable), and upload an initial photo set (client-provided or licensed stock). Within 7 calendar days after setup, we will make one round of corrections to fix factual errors (e.g., hours, category mis-selection, link typos). Ongoing GBP management (posts, review replies, photo refreshes, Q&A monitoring, spam removal requests, etc.) is not included unless purchased separately as a future add-on.

  • Timeline. Typical path is ~4 weeks from Preview approval:

    • Week 1: build kickoff; Week 2–3: page builds & review; Week 4: final edits & launch. Timeline depends on timely Client feedback/content.

  • What’s not included. Custom software, advanced SEO campaigns, paid ads, legal content (privacy/terms), photography, or services not listed here.

4.1 Online Ordering. We configure menu categories/items, modifiers/options, pickup windows, basic promos/upsells, and order notifications. You handle merchant accounts, taxes, and policies.
4.2 Online Bookings. We configure services/durations/prices, staff schedules, buffers, cancellation windows, reminders. You handle staff operations, no-show policies, and payments.

  • Content & brand. Provide accurate business info (services, prices, hours, address, phone, email), brand assets (logo/colors), and any must-use content. You’re responsible for accuracy and legal compliance.

  • Access. Provide domain/DNS access (or add the records we send). Provide required platform logins (never banking).

  • Compliance. You are responsible for your taxes, fees, disclaimers, and industry-specific rules.

  • GBP Access & Verification. Provide the information and access reasonably needed to set up your GBP, including the ability to complete Google’s verification steps (e.g., phone, email, video, or postcard).

  • Accuracy & Compliance. You are responsible for the accuracy and legality of your GBP content (business name, categories, services, pricing, hours, policies) and for complying with Google’s Business Profile policies.

  • Media Rights. You warrant that you have rights to any photos you provide (we may also use licensed stock consistent with your brand).

  • Auto-pay. You authorize recurring monthly charges to your card/ACH on your billing date.

  • Taxes. Prices exclude applicable taxes, which you agree to pay if required.

  • Price Lock. Unless we both agree otherwise in writing, your base website plan and elected add-ons will not increase for the first [24] months from the Effective Date (the “Price-Lock Period”). During the Price-Lock Period, fees may change only if (a) you add pages or services, or (b) a third-party platform we use for your Services increases its fees, in which case we may pass through that increase with 30 days’ notice.

  • After the Price-Lock Period. After the initial [24] months, we may adjust your base plan and add-on fees no more than once every twelve (12) months, capped at the lower of (i) CPI-U (US, prior 12 months) or (ii) 10%, with 30 days’ notice sent to your account email. If you do not agree to the updated price, you may cancel effective at the end of your current billing cycle (see §9).

  • No Mid-Term Increases. Apart from approved scope changes or pass-through platform increases, we will not raise your fees during any fixed-term.

  • Late fee. A $25 late fee applies when any invoice is 5+ days past due.

  • We own: the assembled site’s design system, templates, and licensed stock. While subscribed and in good standing, you receive a license to use the site.

  • Portfolio. Unless you opt out in writing, we may display non-confidential screenshots and your logo in our portfolio.

  • You own: your domain, your logo/brand assets, and all customer/order/booking data.

  • We own: the assembled site’s design system, templates, and licensed stock. While subscribed and in good standing, you receive a license to use the site.

Each has its own terms. Customer payments flow directly to your merchant accounts; we do not access your funds.

We follow good practices (semantic structure, alt text, mobile performance), but we do not guarantee compliance with specific accessibility standards (e.g., WCAG/ADA) or any specific SEO ranking, traffic volume, leads, or revenue. We do not guarantee GBP verification timing, local pack rankings, call volume, or any specific visibility outcomes related to Google Business Profile.

Business performance depends on factors outside our control (market conditions, competition, pricing, reviews, algorithms, third-party platforms, etc.). Third-party services are provided under their own terms and may change or experience downtime; we are not responsible for their performance. Except as expressly stated, the Services are provided “as is” and “as available.”

We will perform the Services with reasonable skill and care. However, we do not guarantee any particular business outcome (traffic, rankings, leads, sales, or revenue). Business performance depends on factors outside our control (market conditions, competition, pricing, reviews, algorithms, third-party platforms, etc.). Third-party services are provided under their own terms and may change or experience downtime; we are not responsible for their performance. Except as expressly stated, the Services are provided “as is” and “as available.”

Local search visibility depends on factors outside our control (e.g., competitor density, reviews, proximity, Google policies). No results are guaranteed from GBP setup.

To the maximum extent permitted by law, each party’s total liability arising out of or relating to the Services in any twelve (12)-month period will not exceed the fees paid or payable by Client to LaunchSite in the three (3) months before the event giving rise to the claim. Neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if advised of the possibility. The above limits do not apply to a party’s willful misconduct or gross negligence, Client’s payment obligations, or either party’s breach of confidentiality or intellectual-property indemnity obligations.

(For larger clients, we may mutually agree in writing to a “six (6) months” cap.)

We may update these Terms and Service Specifications from time to time. Material changes to pricing or key commercial terms will not apply during your active 12-month term unless you agree in writing.
